17 February, 2023
Alliance School of Law organized a guest lecture with Senior Advocate Shri. Udaya Holla on the theme "Constitutional Dynamism in India." The event aimed to educate students on the significance and evolving nature of the Indian Constitution since its inception in 1950. The dynamic nature of the Constitution means that it has evolved over time to meet the specific needs of the society in which it operates.
Senior Advocate Shri. Udaya Holla, a former Advocate General of the High Court of Karnataka, began his lecture by highlighting the importance of the Constitution and the extensive consideration that went into its drafting. He emphasized that the Constitution of a country is not just a set of unchanging rules, but rather a flexible document that can adapt to changing times and circumstances. He made use of two landmark cases, Kesavananda Bharati and Menaka Gandhi, as examples to illustrate his point. These cases demonstrate how creative interpretation and application of the Constitution can help in addressing complex legal issues and ensure that the document remains relevant to the changing needs of society.
Advocate Holla went into detail about the concept of judicial activism, specifically regarding the interpretation of Articles 14, 19, and 21 of the Indian Constitution and provided several examples of landmark cases to elaborate on the concept. He used a specific example to illustrate his point, citing the dissenting judgement of Justices Chandrachud Sr. and Jr., which later became an assenting judgement and expanded the definition of life. Throughout his discussion, Advocate Holla emphasized the importance of creativity in the legal profession.
The Q&A session of the guest lecture saw a lot of student participation wherein they posed a diverse range of questions. The guest lecture was deemed to be an immensely beneficial and enlightening experience by all the students in attendance. The lecture provided them with a deeper understanding of the topic and was an enriching and eye-opening experience about Constitutional Dynamism.
